CONOVER - Police said Tuesday no charges will be filed against the driver of a vehicle that struck an 11-year-old boy Saturday.
A truck hit the boy as he crossed Conover Boulevard between Boundary Street, SW, and Fairway Drive, SW, near McDonald's at about 1:30 p.m.
He was with a group home that had gone to eat lunch at McDonald's with a chaperone, according to police. The boy ran away from the group, said Conover Police Chief Gary LaFone. He turned around and was starting back toward the group when he was hit by a pickup truck pulling a lawnmower on a trailer, LaFone said.
Henry Lee Swink, 58, of Claremont, was driver of the truck.
"According to witnesses, the pedestrian ran across the roadway directly in front of the El Paso Mexican restaurant," said police Lt. Larry Waters.
The vehicle in front of Swink changed lanes suddenly to avoid hitting the child, but Swink didn't have time to react, LaFone said.
"I don't anticipate any charges will be filed against Mr. Swink," LaFone said. "It was completely unavoidable."
The boy was transported to Catawba Valley Medical Center, then airlifted to Carolinas Medical Center in Charlotte, Waters said.
Lafone declined to identify the boy due to his age. Waters said, "The last time I heard, he was in serious condition."
The investigation is ongoing, LaFone said.
