Police: ASU student shot with muzzleloader

The shooting of Appalachian State University student early Sunday morning occurred during a gathering of about seven friends at an apartment near campus, according to a police report.

Jay Derby, 20 of Matthews, was shot with a muzzleloader.

Boone police said that they are trying to determine whether the shooting was an accident or whether negligence was involved. Police will talk with the district attorney about whether to press charges.

Police arrived at 148 Faculty Street, Apt. 6. about 12:30 a.m. Paramedics say Derby was dead when they arrived.

The complex, App South, is home to a large number of students.

Mike Derby says his son was studying business and planned to be home for Thanksgiving.
